These Terms and Conditions ("Terms") govern your access to and use of the Cohabi platform, operated by Buzybytes Solutions (CRO: 759889), Dublin, Ireland ("we", "us", "our"). By registering or using Cohabi, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
1. Eligibility
- You must be at least 18 years of age to use Cohabi.
- You must have legal capacity to enter into a binding contract under Irish law.
- You must not be prohibited from using the Platform under any applicable law.
- You must provide accurate and truthful information during registration.
2. Account Registration
To access the Platform you must create an account by verifying your phone number via OTP or signing in with Google. You are responsible for:
- Maintaining the security and confidentiality of your account
- All activity that occurs under your account
- Notifying us immediately at connect@cohabi.eu if you suspect unauthorised access
We reserve the right to suspend or terminate accounts that contain false, misleading, or fraudulent information.
3. Hosts — Listing Rules
If you post a room listing on Cohabi, you agree that:
- You are the legitimate owner, host, or authorised agent for the property listed
- All information in your listing is accurate, current, and not misleading
- The listed property is real, available, and located in Ireland
- You will not post the same room under multiple listings
- You will not request any payment, deposit, or personal financial information from seekers outside of a legitimate tenancy agreement
- You will not discriminate against seekers based on gender, race, religion, disability, sexual orientation, or any other characteristic protected under the Equal Status Acts 2000–2018 (Ireland)
- Contact details you provide will only be used for genuine housing enquiries
Cohabi reserves the right to remove any listing that violates these rules without notice and without refund of any paid services.
4. Room Seekers — Seeker Pass
To contact Hosts and reveal phone numbers, Room Seekers must purchase a Seeker Pass plan:
- Plan A — Quick Look: €4.99 for 7 days
- Plan B — House Hunter: €14.99 for 30 days (Recommended)
- Plan C — Peace of Mind: €29.99 for 90 days
Upon payment, Seekers receive unlimited access to contact details for the duration of their plan. The Seeker Pass is personal and non-transferable. It grants access to the Platform only — it does not constitute any guarantee of finding accommodation.
5. Prohibited Conduct
You must not use the Platform to:
- Post fraudulent, fake, or scam listings
- Collect personal data from other users for purposes other than genuine housing enquiries
- Harass, threaten, or abuse any other user
- Use automated bots, scrapers, or scripts to access or extract data
- Attempt to circumvent the Seeker Pass paywall
- Post content that is illegal, defamatory, obscene, or discriminatory
- Impersonate another person or entity
- Use the Platform for any commercial purpose other than genuine room rental
Violations may result in immediate account suspension, referral to law enforcement, and/or civil action.
6. Platform Role — We Are an Intermediary
Cohabi is a platform that connects Hosts and Room Seekers. We are not a party to any rental agreement, tenancy contract, or financial transaction between users. We do not:
- Verify the physical condition of any property
- Guarantee the accuracy of any listing
- Act as an estate agent or letting agent under the Property Services (Regulation) Act 2011
- Take responsibility for the conduct of any user
All rental agreements are solely between the host and the Room Seeker. We strongly recommend that all parties use formal tenancy agreements compliant with the Residential Tenancies Act 2004–2022 (Ireland).
7. Payments & Stripe
All payments are processed by Stripe Technology Europe, Limited (registered in Ireland). By making a payment, you also agree to Stripe's Terms of Service. We do not store your card number, CVC, or any sensitive payment credentials. Paid plan fees are charged in Euro (EUR) and are inclusive of VAT where applicable under Irish law.
8. Refunds
Please refer to our separate Refund Policy for full details. In summary:
- Technical failures caused by Cohabi may entitle you to a pro-rata refund or paid plan extension
9. Intellectual Property
All content on the Platform — including the Cohabi name, logo, design, and software — is the intellectual property of Buzybytes Solutions and is protected under Irish and EU intellectual property law. You may not reproduce, distribute, or create derivative works without our written consent.
By uploading content (photos, descriptions) to the Platform, you grant Cohabi a non-exclusive, royalty-free, worldwide licence to use, display, and reproduce that content solely for the purpose of operating the Platform.
10. Limitation of Liability
To the maximum extent permitted by Irish law:
- Cohabi is provided on an "as is" and "as available" basis
- We do not warrant that the Platform will be uninterrupted, error-free, or free from viruses
- We are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Platform
- Our total aggregate liability to you for any claim shall not exceed the amount you paid to us in the 3 months preceding the claim
Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.
11. Governing Law & Dispute Resolution
These Terms are governed by the laws of Ireland. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the Irish courts.
Before initiating legal proceedings, we encourage users to contact us at connect@cohabi.eu to resolve disputes informally.
12. Amendments
We reserve the right to amend these Terms at any time. We will notify registered users of material changes at least 14 days in advance via email or Platform notification. Continued use after that date constitutes acceptance.
